There is a new Federal Circuit and Family Court of Australia (FCFCOA) which is embracing innovation, technology and change. Especially the greater use of more helpful and less expensive dispute resolution to settle family matters “both before and during court proceedings”.
Litigated proceedings should see seen as a last resort. The Court expects people to make genuine attempts to engage in dispute resolution, to avoid the time, cost and stress associated with litigation.
Now all families that are caught up in the legal administration of their family conflict are encouraged, supported and directed to use the services of accredited Family Dispute Resolution Practitioners (FDRP), accredited Mediators and experienced family law Arbitrators.
It is the expectation of the Court that people involved in family law disputes will only make an application to the Court when there is no other readily available means of resolving their dispute.
There is a general expectation that people in dispute will attempt to resolve disputes by compromise, discussion and alternate dispute resolution (ADR) if it is safe to do so.
This expectation applies both before and during proceedings.FCFCOA
